Brief statement of dates and facts: Community Financial Service Center Corp. (CFSC) is in receipt of negotiable instruments from JD Davis Enterprises LLC that were presented by the Payee, Anthony Hughes, in the total amount of $1,500.00. These negotiable instruments were dishonored and marked insufficient funds or "NSF" due to stop payments being placed on them. Pursuant to Wisconsin Statute §403.305, CFSC is a holder in due course because it took the instruments for value, in good faith, and without notice of any defenses or claims against them. The stop payments that were placed are not valid against a holder in due course. CFSC is entitled to payment of the face value of the checks, plus $50.00 in NSF fees and court costs.
